Have you noticed how many contests and giveaways appear on social media every day? Products to win, tag a friend, share and enter. It feels like anyone could set one up with five minutes and a post.

The reality is different. Most of these initiatives violate Italian regulations on prize promotions. And in a world where a report can arrive with a single click, the reputational and legal risk is much higher than it seems.

But there's a second problem, perhaps a more subtle one: most of these contests don't deliver concrete results. They gather likes, a few shares, and then they vanish. They don't generate sales, they don't acquire qualified leads, they don't build anything that lasts.

A properly structured prize contest is a different thing altogether. It's a direct-response marketing activity, with a measurable investment and a return that can be calculated in advance.

Here's how the mechanism works: while the collection points reward loyalty over time, the contest creates peaks of attention and motivation at strategic moments of the year. Someone already taking part in the collection has high engagement, and a well-built contest amplifies that involvement, pushing them to order more within a defined period to increase their chances of winning.

How to legally organize a prize contest in Italy

Here we come to the point that almost no one addresses seriously. In Italy, prize contests are regulated by Presidential Decree 430/2001, and the penalties for those who aren't compliant can be very heavy.

What you need to be compliant:

Regulations. Every contest must have written regulations describing the mechanics, the prizes, the participation methods, the criteria for selecting winners and the timing.

Deposit. A deposit equal to the value of the prizes on offer must be paid at least 15 days before the contest begins. It can be replaced by a bank or insurance guarantee.

PREMA form to the MISE. The documentation must be submitted electronically to the Ministry of Enterprises and Made in Italy before launch.

Notary. Unlike points collections, prize contests require the involvement of a notary to manage the draw, an element that introduces a criterion of skill or luck.

GDPR. The collection of participants' data must be handled in compliance with privacy regulations, with explicit consent and clear disclosure.

It sounds complicated, and in part it is. But relying on a specialized agency makes the process much simpler than it seems from the outside. The risk of not doing it, on the other hand, has never been worth it.
